Mandatory Off Days For Maids (MOM Regulation)

Since January 1, 2023, employers are required to give Migrant Domestic Workers (MDWs) at least one rest day monthly, without the option for compensation in lieu. What Is The Objective Of Implementing The Rest Day Policy?

The objective of implementing the rest day policy for Migrant Domestic Workers (MDWs) is to ensure their well-being by providing them with opportunities to rest, recharge, and engage in social activities. By granting MDWs regular rest days, employers acknowledge their rights, promote work-life balance, and foster a supportive and respectful working environment.

This policy aims to not only comply with legal requirements but also demonstrate compassion and respect towards MDWs as valued members of the household.

How To Compute Off Day Compensation For My Maid?

1. Calculate the daily rate: Divide the monthly salary by the total number of working days in a month.

Daily rate = Monthly salary / Total working days

2. Determine the value of one day’s salary: Divide the monthly salary by the total number of working days in a month.

One day’s salary = Monthly salary / Total working days

3. Remember the mandatory rest day: Ensure that at least one off day per month is not compensated and must be taken by your maid.

For example:

If your maid’s salary is $650 per month and she works 26 days in a month:

Daily rate = $650 / 26 days = $25

One day’s salary = $25 Remember, one of the off days cannot be compensated and must be taken by your maid as mandated by Singapore law.

How Can Rest Days Be Arranged?
Rest days for Migrant Domestic Workers (MDWs) can be arranged through open communication and mutual agreement. Here’s how:

  1. Discuss Preferences: Communicate with your MDW about their rest day preferences and reach a mutual agreement on the arrangement. Consider factors such as their religious observances, personal commitments, and need for rest.

  2. Flexible Days: Rest days need not be fixed on Sundays. They can be arranged on any day of the week based on mutual agreement between you and your MDW.

  3. Split Days: If mutually agreed, rest days can be split into two half days. This provides flexibility for both the employer and the MDW to accommodate their respective schedules.

  4. Deferred Rest Days: While rest days should ideally be scheduled within the week, if necessary, they can be deferred for up to a month with mutual agreement. However, it’s important not to defer them excessively, as MDWs need regular breaks to maintain their well-being.

  5. Providing Rest Days Promptly: As responsible employers, ensure that new MDWs receive their first rest day within the first month of their employment. This demonstrates your commitment to complying with the law and fostering a positive working environment.
